Gwen I. Walraven
Biography

Gwen Walraven’s experience focuses on commercial litigation.  Her current trial practice concentrates on the representation of businesses and individuals in business disputes involving claims such as breach of contract, fraud, breach of fiduciary duty, tortious interference, and intellectual property claims, including domain name disputes filed with the UDRP through ICANN and patent infringement lawsuits.  Gwen also represents corporate creditors in the collection of defaulted loans, foreclosure of secured properties, and perfection of lien claims, as well as lawsuits based on promissory notes, guarantees, and unpaid accounts. Prior to beginning her legal career, Gwen spent 5 years in the television industry, participating in live sports production and directing live sports and news programming.

Representative Matters
  • Successfully defended a provider of telecommunications, engineering, electrical construction and project management services and a supplier of related equipment in a breach of contract dispute.  Gwen obtained a take nothing judgment against the plaintiffs and obtained a judgment in excess of a half a million dollars in favor of the defendants on their counterclaims.
  • Obtained a temporary restraining order and temporary injunction against a former employee/software developer and his employer prohibiting use of certain software and certain communications with existing and potential customers.
  • On behalf of an out of state Plaintiff, Gwen domesticated an order permitting repossession of equipment valued at over $750,000.00 wrongfully detained in Texas and successfully coordinated the retrieval of the equipment.
  • Obtained a significant settlement in favor of a transportation broker in a breach of contract dispute, as part of a team of lawyers.
  • Represented the defendant in a domain name dispute through the UDRP and the appeals process and successfully negotiated settlement of the dispute.
  • Successfully garnished significant funds and other assets in furtherance of collection of judgments totaling over $5,000,000.00, as part of a team of a lawyers.
  • Routinely represents landlords in landlord/tenant disputes and obtains judgments in favor of landlords against tenants and guarantors.
  • Routinely obtains judgments in favor of suppliers of construction products and equipment and conducts post-judgment efforts, including garnishment actions and post-judgment discovery, to collect on the judgments.
