David G. Webster
Biography

David Webster practices complex commercial litigation. He represents clients in Texas and across the United States and has guided domestic clients through legal matters in Canada, Mexico, and Nigeria.


David’s trial experience includes multiple solo and first-chair bench trials and arbitrations. David also has extensive experience with dispositive motions on both sides of the aisle: he has both successfully recovered many 100% judgments for his plaintiff clients and obtained full dismissal for his defendant clients. David also has broad pre-trial and e-discovery experience and handles cases covering the spectrum of legal issues, including sports and entertainment, employer non-subscriber defense, FINRA, U.C.M.J. (military law), contracts, high-stakes business quarrels, construction defects, non-competes, company divorces, and family law. In his work, David has achieved success through the mediation of disputes, resulting in cost-effective outcomes for his clients.

David also represents targets of white collar crime disputes including healthcare and regulation investigations. His representation covers crypto currency issuers, oil and gas brokers and operators, police officers, physicians, hospitals, compounding pharmacies, medical organizations, and medical suppliers. Through this work, David handles matters investigated and prosecuted by, among others, the Department of Justice, the F.B.I., S.E.C., state regulation/boards, the Medicare Fraud Strike Force, the Department of Defense, and the Health and Human Services - Office of Inspector.

David is also keenly experienced in the collection of judgments and the enforcement of creditors’ rights through trials, garnishments, receiverships, charging orders, and other post-judgment collection proceedings aimed at increasing the collectible value of judgments. David has successfully asserted judgment holder and creditor’s claims across the United States, resulting in full recovery of the debt owed.

David continually publishes articles exploring various federal and state legal topics and has contributed, explained, and provided timely legal analysis to CBS Radio on topics in the news including the Jesse Ventura v. Chris Kyle defamation lawsuit.

David began his legal career working in-house for an entertainment arena and professional sports team, where he negotiated and drafted artist and sponsorship contracts, managed litigation issues, and provided management and ownership with strategically-driven risk assessments and solutions.

Before joining Bell Nunnally, David served as an active-duty Judge Advocate General for the U.S. Army, where he represented military forces. Most recently, David served as a U.S. Army Officer with the Texas Army National Guard JAG Corps, assigned as trial counsel for the 56th Infantry Brigade Combat Team.

David is joined at Bell Nunnally by a variety of complementary practice offerings. David is part of the “Litigation: White-Collar Crime & Government Investigations” practice, which has been recognized by Chambers USA in Texas as “Band 3.” Bell Nunnally’s “Corporate/M&A” section has also been recognized by Chambers USA as “Band 1.” Clients frequently comment that Bell Nunnally’s customer service, responsiveness, and price-point far exceeds their experiences with other firms in Texas and in the United States.

Representative Matters
  • Secured a take-nothing summary judgment in $10 million suit against national property group.
  • Obtained numerous multi-million dollar summary judgments against aggressive defendants in breach of contract cases.
  • Successfully obtained receivership over Houston, Texas hotel, resulting in $64M sale for lender client, which covered 100% of investor money, interest, and attorneys’ fees.
  • Secured $1M judgment and complete satisfaction of judgment within five days for Texas lumber supplier client.
  • At trial, obtained a zero-dollar judgment for defendant client in construction litigation involving multi-million dollar residential property.
  • Won multiple bench trials as first chair attorney and obtained 100% judgments for commercial lender clients.
  • In FINRA litigation, obtained full dismissal of claims against e-trading platform client.
  • In SEC administrative proceedings, obtained full dismissal of claims against clients after aggressive briefing and motion practice.
  • Represents sponsorship and marketing product seller in negotiating and consummating numerous contracts, including deals with the Chicago Cubs, Fortune 500 company American Towers LLC, Sound United, HY Attractions Manager, LLC (owner of 30 Hudson Yards, New York, New York), and prominent groups in Las Vegas, Nevada. The annual value of the contracts signed consistently exceed seven figures.
  • Served as lead counsel in dozens of turnover, sequestration, and garnishment matters across Texas and successfully defended these actions at oral argument. Numerous post-judgment actions have resulted in full satisfaction of six-figure judgments.
