Alana Ackels, Mark Shoffner and Mason Jones on Texas Lawbook Offer a COVID-19 Update for Employers

Issues addressed include: the legality of imposed unpaid leaves of absence; whether employers can request medical information; thoughts on what to do if an employee tests positive for the virus; if an employee can refuse to come to work over virus fears; the potential applicability of short-term disability or business interruption insurance; nonsubscriber to workers’ compensation insurance concerns; and thoughts on what employers should be doing. “While much uncertainty remains about the duration of this pandemic, Texas employers must be mindful to comply with new and old legal obligations to protect both the welfare of their employees and the livelihood of their businesses.”
