Bell Nunnally Partner's Lanham Act Verdict Named in "Top Texas Verdicts of 2009"

Bell Nunnally partner Christopher B. Trowbridge has been recognized in Verdict Search’s “Top Business Law Verdicts” of 2009 for obtaining a $670,000 jury verdict for Poly-America, L.P. in Dallas County District Court in a Lanham Act case involving the sale of falsely labeled polyethylene construction film.  Verdict Search created this list of the top Texas verdicts by cataloging the extraordinary accomplishments of lawyers measured by the amount of the jury verdict award. After a four-day jury trial, Trowbridge obtained affirmative findings on Poly-America’s Lanham Act and unfair competition claims against Rodeo Plastic.  He also obtained an affirmative ruling that Rodeo Plastic’s conduct in mislabeling the product was intentional, deliberate, willful, or fraudulent, thus qualifying the case as an “exceptional” one under the Lanham Act, which allowed Poly-America to recover all of its attorneys’ fees.  The Lanham Act prohibits a number of anti-competitive activities, including trademark infringement, trademark dilution, and false advertising.

In addition to this judgment, Trowbridge has recently obtained a $1.1 million dollar judgment in a fraudulent transfer case in Philadelphia and a $4.4 million dollar summary judgment in a breach of contract case in Collin County.  Trowbridge has also recently successfully defended a national broker-dealer in a covenant not to compete claim before a FINRA arbitration panel and a construction products supply company in a contract dispute in a four-day jury trial in Amarillo.  Trowbridge’s clients are nationwide and range from start-up businesses to Fortune 500 companies.
