Jeffrey S. Lowenstein
Biography

Jeffrey Lowenstein's trial practice focuses on the representation of businesses and individuals in a variety of complex commercial matters and business disputes. Jeff has substantial experience representing developers, investors, management, and owners in claims involving real property including construction defects, leasing disputes, contract disputes, and partnership disputes. He also frequently represents clients in lawsuits involving intellectual property claims, including patent, copyright, and trademark infringement, misappropriation of trade secrets, and related claims. Jeff has tried lawsuits, both jury and nonjury, in a variety of forums throughout Texas, including state court, federal court, bankruptcy court, and arbitration.

Representative Matters
  • Secured a $1.5M+ Breach of Contract trial judgment for Defendant and Counter-Plaintiff Bank of Utah in an aircraft lease dispute, including complete denial of all plaintiff’s claims and finding of liability against plaintiff’s parent company and owner under alter ego and veil piercing theories of liability.
  • Obtained summary judgment of non-infringement on behalf of inmate telecommunications provider in litigation involving telephone equipment patents and upheld the summary judgment at the Federal Circuit.
  • Obtained settlement on behalf of an inmate telecommunications provider following a five week jury trial in a case involving client’s alleged wrongful termination of a patent license agreement involving 15 telecommunications equipment and software patents. 
  • Obtained settlement for design patent holder against a multi-national oil company in declaratory judgment action brought to invalidate patents. 
  • Obtained settlement after obtaining temporary injunction preventing interference with customer contracts based on alleged infringement of identification verification software copyrights. 
  • Obtained injunction requiring return of company domain name in ongoing litigation. 
  • Obtained conveyance of trademarked domain name and trademark for national print media company.
  • Representing land developer against alleged real estate fraud claims relating to purported non-disclosure of property conditions.
  • Obtained a defense jury verdict on behalf of golf course owner who was alleged to have caused property damages by disrupting natural water courses.
  • On behalf of an individual plaintiff homeowner, obtained a settlement of construction defect claims. 
  • Served as national coordinating counsel for inmate telecommunications provider in brokering, negotiating, and coordinating resolution of disputes with competitor and involving public contracts with departments of correction throughout the United States. 
  • Represented manufacturer in coordinating and overseeing national product recall in conjunction with the Consumer Product Safety Commission.
  • Obtained a reversal of a $7,000,000 jury verdict on behalf of a medical equipment manufacturer in a wrongful death case.
